The legal object of the offence under article 290 of the Criminal Code of the Republic of Moldova

Abstract
The analysis of the legal object of the offence provided for in Article 290 of the Criminal Code of the Republic of Moldova highlights the complexity of the social values protected through the criminalization of acts concerning the illicit circulation of firearms and ammunition. Although, traditionally, this offence is associated with the protection of public security and public order, an in-depth analysis reveals the multifaceted and complex nature of the legal object, determined by the diversity of the modalities of commission provided by the criminal norm. Thus, in addition to the social relations concerning the legal regime of firearms, certain incriminated conducts, such as theft or illegal commercialization, may also affect the right to property as well as the health of the person, while the illicit use or handling of firearms and ammunition may generate direct risks to human life. Therefore, in this context, the idea of a complex legal object emerges, within which the protected social values are not limited to public security, but also include other fundamental social relations, affected differently depending on the specific nature of the incriminated conduct.
